Zach Mulholland, the plaintiff, lost the democratic primary in district 100 in 2012 after his campaign fliers were illegally seized by the election board and their goons, in violation of a permanent federal injunction in Odgen's 2003 case, in which he was ably represented by Jim Bopp. Apparently the board has been doing this a while and he is the first to call them on it.

 I found this story today. I'll have more on it soon. my former senior partner r j tavel asked me if there was any update on local attorney paul ogden's 2009 lawsuit about trafic court procedures, and paul ogden's's blog has been covering this story.  The case is Zachary Mulholland v. Marion County Election Board, 1:12-CV-1502, and the complaint can be found on Ogden's blog. Oh  here it is as a pdf.


Legal fees mount in candidate's lawsuit. Legal fees paid by taxpayers are piling up in the Marion County Election Board’s year-old fight against an unsuccessful candidate’s lawsuit over campaign materials that the board seized under a disputed state law.Last week, the City-County Council voted 19-6 to allow the Election Board to spend up to $150,000 more on legal fees. Elections Director Angie Nussmeyer says that should cover the cost of outside lawyers through the end of the year. - Indianapolis Star

So the bill for this is going to run some $400,000, when they shoud have just settled and sent an apology.

Beth White, County Clerk, is rumoured to be going to run for higher office. This case won't help. update: it turns out that White strongly opposed the hiring of outside counsel, see here:

Her boy Andrew Mallon on the one hand is a guy who has kept me from voting, in my ongoing voter ID struggle, but also wrote the clever Election Board response brief in Crawford.
