AUSTIN — A court order issued earlier this week barring voter fraud prosecutions in Texas was overturned Friday by the 5th U.S. Circuit Court of Appeals.

The application to vacate the stay entered by the United
States Court of Appeals for the Fifth Circuit on November 3,
2006, presented to Justice Scalia and by him referred to the
Court, is denied.
Justice Souter would grant the application to vacate the stay.
