From happy fun lawyer at the appellate blog: As reported widely, the Supreme Court granted cert. in the Vermont campaign finance case out of the CA2. I leave the comment on this one to the experts, but I thought it was worth reminding you all that at least four CA2 judges felt that "[t]he Act at issue in this case is as unconstitutional as if Vermont were to create a dukedom, apply the thumbscrew, or tax Wisconsin cheese." (In case you couldn't tell, that was Judge Jacobs, joined by Chief Judge Walker and Judges Cabranes and Wesley). [Follow the links back for a few posts on the case].
