Bill would revise campaign-finance regulations

Legislative working group delivered recommendation Monday

The proposed legislation includes internet and social-media websites in the definition of electioneering communication, similar to direct mailers, radio, television and print advertisements, or billboards.

Idaho lawmakers are slated to reconvene in Boise in January, and they’ll hear a proposal to increase the state’s disclosure requirements for political candidates.


The working group met in July, August, October and on Monday. It was co-chaired by Sen. Patti Anne Lodge, R-Huston, and Rep. Fred Wood, R-Burley.
Senate Minority Leader Michelle Stennett, D-Ketchum, served on the working group, and was one of two Democrats along with House Minority Leader Mat Erpelding, D-Boise.
The other members included Rep. John Vander Woude, R-Nampa, Rep. Thomas Loertscher, R-Iona, Rep. Sage Dixon, R-Ponderay, Sen. Todd Lakey, R-Nampa, Sen. Marv Hagedorn, R-Meridian, and Sen. Mark Harris, R-Soda Springs.

Dear Governor Butch Otter:

Please veto any bill purporting to amend campaign disclosure regulations, if it seeks to impose unconstitutional censorship on internet speech.

 Idaho vBarney, 448 P.2d 195 (1968) is a controlling case, in which the state Supreme Court found that a similar disclaimer regulation violated the state constitution. Other controlling cases include Talley v California, Wooley v Maynard, and McIntyre v Ohio. It would be a violation of your oath of office to sign such a bill. In Stewart v Taylor (s d ind 1997) I had Indiana's statute declared unconstitutional, and reached a financial settlement.  I would, if needed, litigate in Idaho, assuming I could find local counsel. Please do the right thing.
